1. LICENSE GRANT

1.1. TRIAL VERSION

This is not free software. Subject to the terms below, you are hereby licensed by Fookes Software to use one copy of the SOFTWARE, on one computer or workstation, for evaluation purposes without charge. "You" means the company, entity, or individual installing or using the SOFTWARE. "Use" means storing, loading, installing, executing, or displaying the SOFTWARE. You may not modify the SOFTWARE or disable any licensing or control features of the SOFTWARE except as an intended part of the SOFTWARE's programming features.

1. LICENSE GRANT

1.1. TRIAL VERSION

This is not free software. Subject to the terms below, you are hereby licensed by Fookes Software to use one copy of the SOFTWARE, on one computer or workstation, for evaluation purposes without charge. "You" means the company, entity, or individual installing or using the SOFTWARE. "Use" means storing, loading, installing, executing, or displaying the SOFTWARE. You may not modify the SOFTWARE or disable any licensing or control features of the SOFTWARE except as an intended part of the SOFTWARE's programming features.

1.2 PAID VERSION

"You" means the company, entity or individual whose funds are used to pay the license fee. "Use" means storing, loading, installing, executing or displaying the SOFTWARE. You may not modify the SOFTWARE or disable any licensing or control features of the SOFTWARE except as an intended part of the SOFTWARE's programming features. This license is not transferable to any other system, or to another organization or individual.

You may access the paid version of the SOFTWARE through a network, provided that you have obtained individual licenses for the software covering all computers that will run the software from the network. For instance, if five different workstations will access the SOFTWARE on the network, you will need a five-user license, whether they use the SOFTWARE at different times or concurrently. 1.2.1. SINGLE-USER LICENSE FOR ONE COMPUTER

Fookes Software grants you a license to use one copy of this SOFTWARE on any one computer for as many licenses as you purchase. Each license may only be used to process the email files (mail folders, mailbox files, or mail profiles) belonging to one person, or the members of one family in the case of private use.

1.2.2. SINGLE-USER LICENSE FOR UP TO THREE COMPUTERS

Fookes Software grants you a license to use one copy of this SOFTWARE on up to three computers for as many licenses as you purchase. The three computers must either all be in a private home and owned by a single person, or used in a business environment by a single person (for example, a user's office desktop, travel laptop, and home computer.) This license does not allow you to use this SOFTWARE as a service for other users that do not have their own license (see Customer-Service License below.)

1.2.3. FORENSIC-EXAMINATION LICENSE

Fookes Software grants you a license to use one copy of this SOFTWARE on any one computer for as many licenses as you purchase. This license allows you to use the SOFTWARE for forensic examination during a litigation or criminal procedure. A single license may be used to process mail belonging to any number of people under investigation as long as it can be operated from the computer on which Aid4Mail is activated.

Alternatively, each license may be used in a non-forensic context to process all email files (mail folders, mailbox files, or mail profiles) belonging to one person, or the members of one family in the case of private use. However, one Forensic-Examination license may not be used both in a forensic and non-forensic context.

1.2.4. CUSTOMER-SERVICE LICENSE

Fookes Software grants you a license to use one copy of this SOFTWARE on any one computer for as many licenses as you purchase. This license allows you to use the SOFTWARE to process mail belonging to other users (staff members, students, clients, etc.)

1.2.5. ENTERPRISE SITE LICENSE

Fookes Software grants you a license to install this SOFTWARE on computers owned by your company/institution/organization/school within a radius of 10 miles (16 km) for up to a maximum of 2000 staff/computers per license, as well as on secondary computers used exclusively by staff members for office work (e.g. travel laptop and home computer). It does not cover installation on computers which are owned by clients or non-hired students of your company/institution/organization/school. This license does not allow you to use this SOFTWARE as a service for clients, students, and other users external to your company/institution/organization/school that do not have their own license (see Customer-Service License above.)

1.2.6. UNLIMITED ENTERPRISE SITE LICENSE

Fookes Software grants you a license to install this SOFTWARE on all computers owned by your company/institution/organization/school at a single site within a radius of 10 miles (16 km) for an unlimited number of staff members. Or you can install this SOFTWARE on computers owned by your company/institution/organization/school at an unlimited number of sites worldwide for up to a total of no more than 2000 staff/computers.

This license also allows installing SOFTWARE on secondary computers used exclusively by staff members for office work (e.g. travel laptop and home computer). It does not cover installation on computers which are owned by clients or students of your company/institution/organization/school. Furthermore, this license does not allow you to use this SOFTWARE as a service for clients, students, and other users external to your company/institution/organization/school that do not have their own license (see Customer-Service License above.)

2. OWNERSHIP

The SOFTWARE is proprietary to Fookes Software. The SOFTWARE is licensed, not sold, to you notwithstanding any reference herein to "purchases." You acknowledge and agree that: (a) the SOFTWARE is protected under U.S. copyright and other laws; (b) Fookes Software and its licensors retain all copyrights and other intellectual property rights in the SOFTWARE; (c) there are no implied licenses under this License, and any rights not expressly granted to you hereunder are reserved by Fookes Software; (d) you acquire no ownership or other interest (other than your license rights) in or to the SOFTWARE; and (e) Fookes Software owns all copies of the SOFTWARE, however made. You agree that you will not, at any time, contest anywhere in the world Fookes Software's ownership of the SOFTWARE, nor will you challenge the validity of Fookes Software's rights in the SOFTWARE. You have no rights hereunder to use any trademark or service mark belonging to Fookes Software.

3. UNAUTHORIZED USE

You may not use, copy, rent, lease, sell, modify, decompile, disassemble, otherwise reverse engineer, or transfer the SOFTWARE except as provided in this agreement. Any such unauthorized use shall result in immediate and automatic termination of this license.

4. DISTRIBUTION

Provided that you are distributing the current trial version of the SOFTWARE (without activation code or registration file) you are hereby licensed to make as many copies of the trial package of the SOFTWARE as you wish; give exact copies of the original trial package of the SOFTWARE to anyone; and distribute the trial package of the SOFTWARE in its unmodified form via electronic means (Internet, BBS's, Shareware distribution libraries, CD-ROMs, etc.). You may charge a distribution fee for the package, but you must not represent in any way that you are selling the software itself.

All distribution of SOFTWARE is further restricted with regard to sources which also distribute virus source code and related virus construction/creation materials. The SOFTWARE may not be made available on any site, CD-ROM, or with any package which makes available or contains viruses, virus source code, virus construction programs, or virus creation material.

Permission to distribute the SOFTWARE is not transferable, assignable, saleable, or franchisable. Each entity wishing to distribute the package must independently satisfy the terms of the distribution license.

5. U.S. GOVERNMENT INFORMATION

Use, duplication, or disclosure by the U.S. Government of the computer software and documentation in this package shall be subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.277-7013 (Oct 1988) and FAR 52.227-19 (Jun 1987). The Contractor is Fookes Software, La Petite Fin 27, 1637 Charmey, Switzerland.

6. LIMITED WARRANTY

This SOFTWARE is provided on an "as is" basis. Fookes Software disclaims all warranties relating to this SOFTWARE, whether expressed or implied, including but not limited to any implied warranties of merchantability or fitness for a particular purpose. Neither Fookes Software nor anyone else who has been involved in the creation, production, or delivery of this SOFTWARE shall be liable for any indirect, consequential, or incidental damages arising out of the use or inability to use such SOFTWARE, even if Fookes Software has been advised of the possibility of such damages or claims. The person using the SOFTWARE bears all risk as to the quality and performance of the SOFTWARE.

Some jurisdictions do not allow limitation or exclusion of incidental or consequential damages, so the above limitations or exclusion may not apply to you to the extent that liability is by law incapable of exclusion or restriction.

In no event shall any theory of liability exceed the license fee paid to Fookes Software.

7. SEVERABILITY

In the event of invalidity of any provision of this license, the parties agree that such invalidity shall not affect the validity of the remaining portions of this license.

8. NO LIABILITY FOR CONSEQUENTIAL DAMAGES

In no event shall Fookes Software or its suppliers be liable to you for any consequential, special, incidental, or indirect damages of any kind arising out of the delivery, performance, or use of the SOFTWARE, even if Fookes Software has been advised of the possibility of such damages. In no event will Fookes Software's liability for any claim, whether in contract, tort, or any other theory of liability, exceed the license fee paid by you, if any.

9. GOVERNING LAW

This agreement shall be governed by the laws of Switzerland, excluding the application of its conflicts of law rules, and shall inure to the benefit of Fookes Software and any successors, administrators, heirs, and assigns. Any action or proceeding brought by either party against the other arising out of or related to this agreement shall be brought only in a COURT of competent jurisdiction located in Switzerland. The parties hereby consent to in personam jurisdiction of said courts. The United Nations Convention on Contracts for the International Sale of Goods is specifically disclaimed.

10. INSPECTION AND TESTING

You agree and acknowledge that you will thoroughly inspect and test the SOFTWARE for all of your purposes upon commencement of your use. Any suit or other legal action, claim, or any arbitration relating in any way to this agreement or software covered by it must be officially filed or officially commenced no later than 90 days after your first use of the software.

11. ENTIRE AGREEMENT

This is the entire agreement between you and Fookes Software, which supersedes any prior agreement or understanding, whether written or oral, relating to the subject matter of this license.

12. RESERVED RIGHTS

All rights not expressly granted here are reserved to Fookes Software.
